I've noticed that this has not been corrected yet. The observer should only get the benefit of a "no deflection" shot if the target is 2 or 3 spaces DIRECTLY BEHIND his aircraft and facing either the same or opposite to his aircraft's facing. All other shots by observers should include the "deflection" penalty.
I imagine it is tricky to program this because it deals with the observer's field of fire. Maybe instead of using "no deflection" as the default for observers shooting and then comparing relative facings of the target and shooter as the primary test for whether the shot is deflection or not, you can apply the deflection modifier to all observer shots and apply a positive "no deflection" modifier to compensate in those few cases where it should be a no deflection shot.
