I couldn't leave the police HQ without saying who is my lawyer (wich of course I didn't have), or have accepted the office lawyer. That was a kind situation. The prosecution paper said that the documents against me are the girl accusation and witnesses depositions!!!. Me in a police office, being witness of an accident and being accused to be the responsible of it, from a person who clearly seen that I wasn't, and from witnesses !!!!
I had to option to nominate one the day of the interrogation. I spent a week, cheking a bit the italian penal code (being judged guilty for 590c.p. u can be condamned up to 3 months of jail, about 300 Eu of charge to State, and of course the compensation of the victim) and the lawyers I could contact. Thinking why the hell she did that. I thought she could be pressed by parents, looking for some easy money...and who witnessed against me ?? I reached the "Republic prosecutor offices" (Procura), asking for the documents, but they replied I couldn't check those untill I was interrogated.
I choosed a nice penal lawyer, and asked him that if the thing didn't cleared up really soon I'll attack, accusing the girl of slander and the witness/es (if they really exists) of faked depositions (falsa testimonianza). The charge of the first phase inquiries will be on my own, having you to pay in penal code your own lawyer. I could be refunded if I attack as said above and win the prosecution, wich can need severalk months though.
I was interrogated yesterday in presence of my lawyer, being adviced of my rights (u can respond or not, everything you say can be used against you, u can claim right of no-reply..ecc ecc). I was incredule and indignated.
My lawyer asked want to see the documents, read the witness depositions before act, so said me not to reply the interrogation.
Tomorrow I'll go again in "Republic prosecutor offices" and check who witnessed against me. I won't give up such a coward attack, even if I'll have to spend some money.... but can u really give a price on your dignity ?
