So my answer would be: The strongest "alliance" remaining on the battle field is the winner. And in that case all remaining players of that side score. Who breaks away, loses. (This, too, would avoid "tactical" retreats, like "Ok, I destroyed one frigate more. It's time to bugger off.")

"Tacitcal" victories (like the British one at Chesapeak Bay) should be easy to handle within those rules. "Who remains on station, and has more and stronger ships alive and has not surrendered at the end of preset number of game turns, is the winner."
