Rules-wise, it should be enforced: engine destroyed/out of fuel is a secret information, and you would have to say it, otherwise. And I bet that it is the way it is implemented on the website, since from a programming point of view you would have to add in an exception in the algorithm, and I doubt that the webmasters have done this.
But I would like the webmasters to confirm this
I think I have shot down an opponent under the circumstances you describe so I would say that the plane moving at the 1 speed gets the shot.
