It's definitely a reloading issue. On turn 33 Invincible fired both broadsides. Since then she's been firing at Diademe. If hussar61 didn't set that, it's been by random chance. If you want to specify which side fires, you need to set it, otherwise the computer picks one randomly. In this case, the closest ship has nothing to do with which broadside is reloaded.
The firing-at-the-closest-ship thing is per broadside, not per ship. Each broadside must fire at the closest ship. See the "Fire Eligibility" section of the rules.
Someone mentioned the reloading issue should be in the rules. Since it's so important, it's definitely there:
It's important to note that any ship can fire both of its broadsides in the same turn, but can only reload one broadside per turn. The Load: option Any side will automatically reload any single broadside, but if a ship fires both broadsides and you want to specify which one to reload, you should pick the right or left side. If you don't, it will pick one randomly.

Ships can fire both broadsides in one turn, but can only reload one. You can pick which side to reload with the "Load" pulldown list. If you don't pick, the game chooses a side randomly, so you could easily lose a rake or not finish off a badly damaged ship. Don't forget to reset it if that ships turns or you want to fire the other side.
So how do you know if both broadsides have fired? The brown "fired" image will appear on both sides, like on Formidable to the right.
