Is it a strategic? One side completely destroy the other and remain the only side on the map. So no.

Tactical? If, at the end of the game, there is more than one side remaining on the board, the victory could be tactical. Because erialc left with honor (see not above) it's no again.

Marginal? If the percentage of unit lost is the same, then we have a marginal victory only if the total points scored by a side exceed by more than 15% the points score by opponents. Both sides lost 0% of the starting force, and 35 * 1.15 = 40 so 38 points is not enough.

And that leaves a draw. If the percentage of unit lost is the same and the total points scored by a side does not exceed the other by more than 15%, no winning side is determined, and only personal score is assigned.
