Hope this helps.
I would appear that if there is a captured ship, with prisoners [6 French crew, 10 British prisoners]. If the British attempt to capture the same turn the French abandon the ship, then the prisoners stay prisoners only under the British.
Happened in game 461900, with Orient Indomitable and Britania.
