I think this agreement makes the games less interesting.
1) If you're out of fuel, it's your fault: you deserve to be shot down
2) It is sometimes very interesting to feign a broken engine or no fuel, and the try a shot at distance zero. Alright, the chances of accomplishing this are thin, but I've witnessed a couple of games where it worked.
On that note, what is the general opinion if someone declares that they are gliding and asks for mercy?
How? I have no radio on my plane, have you?
